For a country to legalize drugs, of course, it needs a strong social consensus. However, it is not obvious that the US will ever legalize cocaine because it is so popular and so costly. Germany and Portugal have already decriminalized narcotics; the latter state reported that the policy saved about €3.3 billion in 2011. A further study by the Zurich Commission on International Drug Policy recommended that all countries that allow people to possess and use small quantities of drugs be willing to follow Portugal’s lead and decriminalize possession of more than a small amount, while governments should be willing to make sufficient resources available for drug treatment to make it widely available.

The UK could tax and regulate cannabis, and it should, but it cannot just legalize all the rest of the drugs. The US cannot legalize all the rest of the drugs. The UK cannot change too fast and become the world’s cannabis powerhouse. It can only legalize a bit more than Portugal.

Legalization would enable drug use to be regulated and controlled in a much safer way than today’s system. Governments would no longer have to rely on criminal enforcement, which is a wasteful, intrusive, stigmatizing, destructive and counterproductive policy. They would be able to spend their time and resources on more productive things.

We would not need armies of drug warriors to enforce the status quo. We would not need to pay millions in costs incurred through criminalization of drugs. We would not need to imprison and stigmatize people in jail.

The people who use these products, however, are still buying and using the illegal versions, with the same risks as in the past. Their number will probably be reduced, but they will still be at risk. A better risk-sharing arrangement is to make strong drugs available on prescription in a regulated way.
